Legal Foundations for Tenders and Contracts
In line with both the laws of Kenya and the Code of Canon Law of the Catholic Church, the Catholic Diocese of Maralal undertakes all tendering and contractual processes guided by principles of fairness, transparency, accountability, and stewardship.
1. Kenyan Law
Constitution of Kenya, Article 227 (1):
“When a state organ or any other public entity contracts for goods or services, it shall do so in accordance with a system that is fair, equitable, transparent, competitive, and cost-effective.”Constitution of Kenya, Article 227 (2):
“An Act of Parliament shall prescribe a framework within which policies relating to procurement and asset disposal shall be implemented and may provide for categories of preference in the allocation of contracts, protection of disadvantaged groups, and sanctions against contractors that fail to perform or engage in corruption.”Public Procurement and Asset Disposal Act, 2015 (Preamble):
“An Act of Parliament to give effect to Article 227 of the Constitution; to provide procedures for efficient public procurement and for assets’ disposal by public entities; and for connected purposes.”
2. Canonical Principles:
“Church Tenders” isn’t explicitly defined in the Code of Canon Law; nevertheless, it is deducible that pertinent canons essentially outline the principles of accountability, transparency, and due diligence for any project involving the Catholic Church, her properties, or funds.
Hence, emphasis on the:
- Adherence to both Canon Law and civil laws.
- Procedures for ensuring that Church resources are managed prudently and effectively.
- A commitment to fairness and justice in all financial dealings.
The Church has the inherent right to acquire, retain, administer, and alienate temporal goods to fund divine worship, support clergy, and carry out apostolic works and works of charity (cfr. Canon 1254)
Respect for Civil Law demands that administrators of church goods respect and observe applicable civil laws when undertaking contracts or managing property, by ensuring compliance with both ecclesiastical and secular regulations (cfr. Canons 1254, 1286)
